This Privacy Policy explains how Early Game LLC (“PhytoFamily,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit phytofamily.com or phytofamily.com (together, the “Site”) or make a purchase from us.

1. Who We Are
PhytoFamily is a hemp brand based in Tucson, Arizona. We sell hemp-derived products that are federally legal under the Agriculture Improvement Act of 2018 (the “2018 Farm Bill”). The Site is operated by Early Game LLC, with a mailing address of 1830 E Broadway Blvd, Ste 124-42, Tucson, AZ 85719.
The Site is intended only for adults aged 21 and over.
2. Information We Collect
We collect personal information in three ways: information you provide to us directly, information collected automatically when you use the Site, and information we receive from third parties.
Information you provide to us
- Order information — name, billing address, shipping address, email address, phone number, and payment information when you place an order.
- Account information — username, password, and saved preferences if you create a customer account.
- Communications — messages you send us via email, contact forms, live chat, or social media.
- Marketing preferences — if you subscribe to our email list, your email address and any preferences you share with us.
- Survey and feedback responses — when you respond to a request for feedback or complete a form on the Site.
Information collected automatically
When you visit the Site, we automatically collect certain information about your browser and device (“Device Information”):
- IP address, browser type, operating system, time zone, language settings, and referring and exit pages
- Pages viewed, links clicked, time spent on pages, and search terms used on the Site
- Information collected via cookies, log files, web beacons, tags, and pixels
Information from third parties
- Payment confirmations from our payment processor (Authorize.Net). We do not store full payment card numbers; the processor handles that information directly.
- Shipping status updates from carriers (such as USPS) for orders we ship.
- Analytics data from Google Analytics regarding aggregated and pseudonymized Site usage.
- Social media data when you interact with our pages or click through from a social platform.
When this Policy refers to “personal information,” we mean both the information you provide and the Device Information described above.
3. How We Use Your Information
We use the information we collect for the following purposes:
- To fulfill orders — process payments, ship products, send order and shipping confirmations, and handle returns and refunds.
- To operate the Site — keep the Site running, secure, and performant, including serving pages via our content delivery network (Cloudflare).
- To improve our products and Site — analyze how customers use the Site and understand product performance.
- To communicate with you — respond to questions, send order updates and shipping notifications, and, with your permission, send marketing emails about new products, promotions, and brand news.
- To personalize your experience — display products and content relevant to your interests and remember your preferences across visits.
- To detect and prevent fraud — screen orders for suspicious activity, block automated abuse, and protect against payment fraud.
- To comply with the law — respond to subpoenas, court orders, and other legal requirements, and to enforce our Terms of Service.
4. Cookies and Tracking Technologies
We and our service providers use cookies and similar technologies to operate the Site and to understand how it is used.
- Strictly necessary cookies are required for the Site to function (for example, to maintain cart contents, complete checkout, and manage login sessions). These cookies cannot be disabled.
- Performance and analytics cookies help us understand how visitors use the Site through Google Analytics. Google Signals and display-advertising support are currently disabled.
- Functional cookies remember your preferences (for example, cart contents and saved addresses).
You can control cookies through your browser settings. Most browsers allow you to block all cookies, block third-party cookies, or delete cookies after each session. Please note that blocking strictly necessary cookies will impair Site functionality (including the cart and checkout).
We do not currently respond to “Do Not Track” browser signals. We do not currently sell personal information or use personal information collected through the Site for targeted advertising.
5. How We Share Information
We share personal information only with parties that help us operate the Site and our business. We do not sell your personal information for monetary consideration.

- Brevo — email-list management and marketing email where you have opted in

- Imagify — image optimization
Legal and safety
We may disclose personal information to comply with applicable laws, respond to lawful requests from authorities, enforce our terms, or protect the rights, property, and safety of PhytoFamily, our customers, and others.
Business transfers
If PhytoFamily is involved in a merger, acquisition, financing, reorganization, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you of any such change as required by law.
6. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.
- Order information is retained for at least seven (7) years to comply with tax, accounting, and consumer-protection laws, and is then archived or deleted.
- Account information is retained for as long as your account is active and is deleted upon request, subject to applicable legal retention requirements.
- Marketing preferences are retained until you unsubscribe.
- Analytics data is retained in accordance with our configured Google Analytics retention settings.
- Support communications are retained as long as reasonably necessary to respond to requests and maintain appropriate business records.
If you request deletion of your personal information, we will honor your request unless a specific legal obligation requires us to retain it (for example, tax records).
7. Your Privacy Rights
Depending on the state in which you reside, you may have the following rights regarding your personal information:
- Right to know and access — request a copy of the personal information we hold about you.
- Right to correct — request that we correct inaccurate or incomplete personal information.
- Right to delete — request that we delete personal information we hold about you.
- Right to data portability — receive your personal information in a portable, machine-readable format.
- Right to opt out of sale or sharing — opt out of disclosures of personal information that may qualify as a “sale” or “sharing” for targeted-advertising purposes.
- Right to opt out of profiling — opt out of automated decision-making that produces legal or similarly significant effects. We do not currently engage in this type of profiling.
- Right to limit use of sensitive personal information — we do not collect sensitive personal information categories such as government-issued identifiers, precise geolocation, health information, or biometric information.
- Right to non-discrimination — we will not deny service, charge different prices, or provide a different quality of service because you exercised a privacy right.
How to exercise your rights
Email support@phytofamily.com with the subject line “Privacy Request” and describe the right you wish to exercise. We may need to verify your identity before fulfilling your request (for example, by matching your request to an existing order). We will respond within 45 days where required by applicable law and may extend this period as permitted.
You may designate an authorized agent to make a request on your behalf. The agent must provide written proof of your authorization.

State-specific notices
California residents have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the rights to know, delete, correct, limit use of sensitive personal information, and opt out of sale and sharing. The categories of personal information we collect, the sources of that information, the purposes for which we use it, and the categories of recipients are described in Sections 2, 3, and 5.
Virginia, Colorado, Connecticut, and Utah residents have similar rights under the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), and the Utah Consumer Privacy Act (UCPA), respectively. The procedures in this section apply to your requests.
Nevada residents may opt out of the sale of certain personal information by emailing support@phytofamily.com.
If we deny your privacy request, you have the right to appeal. Reply to our denial email and we will reconsider your request.
8. Children’s Privacy
The Site is intended only for adults 21 years of age or older and is not directed to anyone under 21. We do not knowingly collect personal information through the Site from anyone under 21. If you believe someone under 21 has provided us with personal information, please contact us at support@phytofamily.com and we will promptly delete it.
9. Security
We use commercially reasonable safeguards to protect personal information, including encrypted connections (HTTPS), a security-focused content delivery network (Cloudflare), and restricted internal access to customer data. Payment information is handled by a PCI-compliant processor (Authorize.Net) and is not stored on our servers.
No method of transmission over the internet or method of electronic storage is one hundred percent secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you as required by applicable law.
10. Third-Party Links
The Site may contain links to third-party websites and services, including laboratory result documents, social media platforms, and external publications. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before sharing personal information with them.
11. International Visitors
The Site is operated from the United States and is intended for users located in the United States. If you access the Site from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, which may have data-protection laws that differ from those in your country.
12. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, the services we use, or applicable law. The “Last updated” date at the top of this Policy reflects the most recent revision. If we make material changes, we will provide a more prominent notice on the Site or by email where required.
